Popular Amendments: The Relevance of Public Participation in Maintaining Democracy

Abstract

This study analyzes the popular legislative initiative as an instrument of direct participation in the Brazilian Democratic Rule of Law, focusing on its practical effectiveness. Although foreseen in the 1988 Federal Constitution as an expression of popular sovereignty, its concrete application reveals structural, legal, and social limitations. The research starts from the observation that contemporary democracy cannot be understood solely from a representative perspective, requiring the expansion of participatory mechanisms that bring citizens and political institutions closer together. In this context, the popular initiative emerges as an important tool for democratization, allowing society to participate directly in normative elaboration. However, its use is still restricted, mainly due to rigorous formal requirements, such as the collection of signatures on a national scale, in addition to the dependence on organized mobilization. The case of the Clean Record Law exemplifies both the potential and the difficulties of this instrument. The critical analysis shows that, despite legal recognition, the popular initiative faces obstacles that compromise its effectiveness, including social inequalities, low political education, and institutional limitations. Furthermore, the actions of the Judiciary, while valuing citizen participation, tend to reinforce formal requirements, hindering the expansion of access. It is concluded that strengthening participatory democracy in Brazil depends not only on normative provisions, but also on the adoption of measures that make the instruments more accessible and inclusive. Thus, popular initiative, although relevant, still operates in a limited way, requiring structural transformations for it to consolidate as an effective mechanism of democratic participation.
