Protection Against Discrimination in Same-Sex Adoption in Brazil: an analysis of CNJ Resolution n° 532/2023 and its impacts on the effectiveness of the right to inclusive family formation

Protection against discrimination in adoption by same-sex couples is analyzed based on CNJ Resolution No. 532/2023 and its implications for the right to inclusive family formation. The study is grounded in the constitutional principles of human dignity, material equality, and family pluralism, as well as in the consolidated case law of the Brazilian Supreme Federal Court regarding the recognition of same-sex unions as family entities. A qualitative, bibliographic, documentary, and normative approach is adopted, with an analysis of scientific literature, legal doctrine, judicial decisions, and institutional documents related to the adoption system. The analysis indicates that, despite the existence of consistent normative bases for the protection of same-sex families in the Brazilian legal system, discriminatory practices may still persist at the institutional level, influenced by cultural, structural, and regional factors. CNJ Resolution No. 532/2023 is a relevant instrument of judicial governance, as it establishes guidelines to prevent prejudice, promote the training of legal professionals, and strengthen supervisory mechanisms. Its application may contribute to expanding legal protection for adoption by same-sex couples, reducing margins of discriminatory subjectivity in decision-making, and reinforcing the principle of the best interests of the child. It is concluded that the effectiveness of the right to inclusive family formation requires the internalization of constitutional values in the justice system, the continuity of judicial public policies, and the strengthening of an institutional culture committed to human rights, dignity, and equality. The study highlights the role of the National Council of Justice in promoting anti-discriminatory judicial practices and points to the need for permanent monitoring to ensure inclusive adoption in Brazil.
