Judicial activism and democracy

This article examines the judicial activism exercised by the Brazilian Supreme Federal Court (STF) in the consolidation and/or weakening of Brazilian democracy. Discussions about this phenomenon involve legal scholars, specialists, and the general public. On one side, there is the National Congress, as a representative of the Legislative Branch, and part of society that understands that judicial activism promotes the overreach of governmental branches, exceeding constitutionally established limits. On the other side, there are those who defend the Judiciary’s role as a necessary mechanism for the realization of fundamental rights and the protection of the Constitution. The relevance of this work lies in analyzing whether the Supreme Federal Court (STF), through judicial activism, contributes to the consolidation or weakening of democracy. In this context, the central research question is formulated as follows: does the judicial activism exercised by the Supreme Federal Court (STF) consolidate or weaken Brazilian democracy? To answer this question, the following objectives are established: to conceptualize judicial activism; to differentiate judicial activism from the judicialization of politics; to trace the origins of judicial activism in different jurisdictions and its adaptation in Brazil; and to explain the constitutional principles that underpin the Judiciary’s actions on this issue. The methodology used consists essentially of bibliographic and theoretical research, based on the study of legal doctrine and scientific articles in the field. The investigation is developed through logical-deductive (syllogistic) reasoning, seeking to arrive at a coherent and well-founded conclusion based on the premises presented. Finally, the study concludes that judicial activism, when exercised expansively and without regard for constitutional parameters, can contribute to the weakening of Brazilian democracy. Therefore, strict observance of constitutional limits and the principle of separation of powers is indispensable to preserve institutional balance, the full exercise of democracy, and popular sovereignty, considering the elements analyzed throughout the study.
